    Повышение ставок по кредитам В марте этого года вступили в силу поправки к статье 29 закона «О банках и банковской деятельности». Формально они запрещают банкам без согласия заемщика повышать ставку кредита. Считается, что поправки, внесенные в закон «О банках и банковской деятельности», запрещают кредитным организациям повышать ставки по уже выданным займам, но на самом деле они разрешают это делать! Дело в том, что теперь, заключая договор с клиентом, банк должен указывать в нем не только кредитную ставку, но и правила ее формирования. Тариф без согласия заемщика банк не может менять только в тех случаях, которые не указаны в правилах формирования ставки. Но ничто не мешает банку заранее прописать в этих правилах все ситуации, в которых он может пойти на повышение ставки. В правила можно «зашить» все, что угодно. Например, можно совершенно легально написать, что каждый раз, когда у банка уменьшается прибыль, он имеет право в 2 раза увеличить проценты по кредиту – и это не будет противоречить закону. В своем итоговом варианте поправки в закон получились абсолютно анекдотичными. Изначально внесенный в Думу законопроект был совершенно иным, в нем содержался категоричный запрет на возможность банка в одностороннем порядке изменить ставку, причем даже в том случае, если подобный вариант был прописан в заключенном с заемщиком кредитном договоре. Именно в таком виде Дума приняла нормативные поправки в первом чтении, но уже ко второму рассмотрению их радикально изменили, и в такой редакции они были окончательно утверждены и Думой, и Советом Федерации.
